Coverage Highlights


  • Who is an insured?
    • You, as the named insured of the policy.
    • Your employees, while acting in the scope of their employment with you.
    • Anyone for whom you are legally responsible, while performing duties related to the conduct of your practice.*
    • Your corporation, partnership or professional association sharing your professional liability limits; separate limits may be purchased.
    • Temporary substitute (Locum Tenens) subject to carrier notification.

    *A must for any podiatrist in that you can be held vicariously liable for actions of employees, independent contractors, employed podiatrists and even specialists to whom you refer patients.


  • Defense Costs for a covered claim are paid in addition to your limits of liability. The policy also will provide $500 per day for your actual lost earnings because of time off of work to assist us in the investigation or defense of the claim or suit.


  • Various limit options are available up to $1 million/$3 million

    • $100,000 per claim/$300,000 aggregate
    • $200,000 per claim/$600,000 aggregate
    • $250,000 per claim/$750,000 aggregate
    • $500,000 per claim/$1,500,000 aggregate
    • $1 million per claim/$1 million aggregate
    • $1 million per claim/$3 million aggregate
    • $1.3 million per claim/$3.9 million aggregate (New York only)

    Aggregate refers to the maximum dollar amount the policy will pay for all claims reported during the policy year.


  • Prior Acts Coverage may be available for prior claims made policies. Prior acts coverage affords protection for acts that occurred prior to the effective date of your ACE policy, provided (1) that event was not known by any insured or reported to your prior insurance carrier; and (2) you have had continuous insurance coverage for such prior acts. Prior acts coverage means you would not need to purchase Extended Reporting Coverage "tail" from your prior insurance carrier.


  • Extended Reporting Period (ERP) Coverage "tail" is provided free of charge at retirement regardless of your age provided you have been insured with ACE for 5 years or more. Free ERP is also provided for full disability or death of an insured.


  • Consent to Settle - The Podiatry PLUS policy contains a consent to settle provision that stipulates the insurance carrier will not settle a claim on your behalf without your consent.


  • Personal and Advertising Injury protects you against claims involving malicious prosecution, false arrest/detention, libel or slander and advertising offenses such as infringement upon another's copyright or use of another's advertising idea in your advertisement.


  • Peer Review, Disciplinary Hearing or Other Regulatory Actions - This coverage pays reasonable defense costs incurred to defend you against governmental, professional, regulatory or other similar administrative action resulting from an otherwise covered injury or damage by this policy. These defense costs are covered by your professional liability limit of liability.


  • First Aid Coverage pays up to $5,000 in expenses for first aid or emergency medical care due to an occurrence caused by a podiatric incident.


  • Medical Waste Legal Expense pays up to $50,000 per suit/$50,000 aggregate for the legal expense incurred by you from a civil action alleging a violation of a law or regulation governing the disposal of medical waste.


  • Medicare/Medicaid Legal Expense - This optional coverage pays up to $30,000 per action/$30,000 aggregate for legal expense you incur in defense of a federal or state agency audit, investigation, administrative proceeding or legal action relating to your participation in the Medicare or Medicaid programs.
